HinSchG Obligations: What Companies Need to Know

The German Whistleblower Protection Act (HinSchG) requires companies with 50 or more employees to establish internal reporting channels. But what does this mean in practice for your company?

Who is affected?

Since December 17, 2023, the obligation applies to all companies with at least 50 employees. Larger companies with more than 250 employees have already been required to maintain an internal reporting channel since July 2023.

What must the reporting channel provide?

The internal reporting channel must meet several requirements:

  • Confidentiality: The whistleblower’s identity must be protected
  • Accessibility: Reports must be possible verbally, in writing, or in person
  • Deadlines: Acknowledgment of receipt within 7 days, feedback within 3 months
  • Independence: The person handling reports must be independent and competent

What penalties apply?

Violations of the HinSchG can result in fines of up to EUR 50,000. Obstructing reports or retaliating against whistleblowers is considered particularly serious.
